1. Agreement to Terms

By accessing or using FindMyCarPart's website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Use of Services

Eligibility

You must be at least 18 years old to use our services. By using FindMyCarPart, you represent and warrant that you meet this age requirement.

Account Registration

To access certain features, you must register for an account. You agree to:

  • Promptly update any changes to your information

3. Service Description

FindMyCarPart provides a marketplace platform connecting buyers seeking auto parts with sellers offering those parts. We facilitate communication and transactions but are not a party to the actual sale of parts.

For Buyers

  • Post requests for specific auto parts
  • Receive offers from verified sellers
  • Communicate directly with sellers
  • Manage vehicle information

For Sellers

  • Browse and respond to buyer requests
  • Submit competitive offers
  • Access seller dashboard (subscription required)
  • Connect with potential buyers

4. Relationships with other Members

a. Platform Purpose

You understand and acknowledge that the Site, including, without limitation, the FindMyCarPart.com System, is provided to you solely as a means of helping you connect with companies and individuals in the auto transport industry and providing you with related business management tools.

b. No Monitoring Obligations

Without limiting the generality of anything set forth in these Terms of Use, you also acknowledge and agree that we have no monitoring, enforcement, or other obligations or responsibilities in relation to the Members, any data, information, or materials provided by them, their businesses, or any business relationships between Members.

c. Member Relationships and Risk

If you decide to enter into a business relationship with a Member, you understand, acknowledge, and agree that you do so at your sole risk and that you are solely responsible for managing such business relationship and enforcing any and all rights and remedies you may have exclusively against such Member.

d. Transactions Between Members

Any agreement, transaction, or contract for the purchase, sale, or exchange of auto parts made through the Site is entered into solely between the Buyer and the Seller. FindMyCarPart does not act as a seller, reseller, distributor, broker, agent, or representative of any Buyer or Seller, and is not a party to any such transaction. We do not assume any responsibility or liability for the performance, fulfillment, pricing, delivery, quality, condition, legality, or compatibility of any auto parts exchanged between Buyers and Sellers.

e. No Guarantees

FindMyCarPart makes no representations or warranties regarding the availability, accuracy, completeness, reliability, condition, compatibility, pricing, delivery method, or delivery time of any auto parts listed, offered, or sold by Sellers on the Site. All interactions, communications, and transactions between Buyers and Sellers are conducted at their own risk.

f. Release of Claims

If you have a dispute with one or more Members, you hereby acknowledge and agree that you release FindMyCarPart.com (and its affiliates, and their respective directors, officers, and employees) from any claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

5. Fees and Payment

Subscription Plans

Sellers must maintain an active subscription to submit offers. Current pricing and features are available on our website.

Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees.

Refund Policy

Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time, effective at the end of the current billing period.

6. User Conduct

You agree not to:

  • Provide false or misleading information
  • Engage in fraudulent activities
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm other users
  • Attempt to circumvent platform fees
  • Use automated systems to access the service
  • Interfere with the proper functioning of the platform

7. Content and Intellectual Property

User Content

You retain ownership of content you post but grant us a license to use, display, and distribute it in connection with our services.

Platform Content

All platform content, features, and functionality are owned by FindMyCarPart and protected by copyright, trademark, and other laws.

8. Disclaimers

FindMyCarPart:

  • Is not responsible for the quality, safety, or legality of parts
  • Does not guarantee the accuracy of user information
  • Is not a party to transactions between buyers and sellers
  • Does not provide warranties for parts sold through the platform

The service is provided "as is" without warranties of any kind, either express or implied.

9. Limitation of Liability

To the fullest extent permitted by law, FindMyCarPart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. Indemnification

You agree to indemnify and hold harmless FindMyCarPart from any claims, damages, losses, and expenses arising from your use of the service or violation of these terms.

11. Dispute Resolution

Any disputes arising from these terms or your use of FindMyCarPart shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Termination

We may terminate or suspend your account at any time for violations of these terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting support.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the new terms.

14. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
